Cieľom tohto textu je poukázať na „odpornosť“ knihy O gramatológii, ktorú tu stotožňujeme s odporom voči kritike (v texte ale implicitne pracujeme s obomi významami slova „odpor“). Prvý z týchto významov slova „odpor“ spájame s Derridovým neografizmom „restance“, a tým vlastne navrhujeme preklad tohto neografizmu do slovenčiny (odporovanie). Toto odporovanie súvisí s odolávaním voči pojmovosti, voči transparentnému prenosu významu. V závere hovoríme o istej radikálnosti takto poňatého odporu, ktorým sa kniha O gramatológii vyznačuje., This paper aims to highlight “ugliness”, of which the book Of Grammatology is certainly not devoid. This ugliness is identified here with a resistance to critique (in the Slovak language the words meaning “ugliness” and “resistance” share a common root – “odpor” and “odpornosť”). It is resistance referring to a “rester”, to something that rests in its place without being penetrated by conceptuality, a transparent transport of the meaning. We propose a translation of Derrida’s term “restance” to Slovak. Contrary to what is often believed, we claim that Of Gramatology is more radically resistant – more silent., and Nous entendons de montrer dans notre texte que la « résistance » par laquelle se signale le livre De la grammatologie, identifiée ici avec la résistance envers la critique (tout en travaillant dans notre texte avec les deux significations de mot la « résistance »). Nous joignons la première signification du mot la « résistance » avec le néographisme derridien « restance » et par là nous proposons de traduire ce néographisme en slovaque comme « odporovanie ». Le mot slovaque « odporovanie » se relie à la résistance contre la conceptualité, contre la transposition transparente de la signification. Nous parlons à la fin de notre texte de la radicalité certaine de cette résistance, si caractéristique pour le livre De la grammatologie.

3. Pět tichých minut za Viktorem Knappem

Viktor Knapp byl jednou z nejvýznamnějších osobností v historii českého a československého práva. Tento text se zaměřuje na Knappovu práci v oboru právní informatiky, informační teorie práva a práva informačních a komunikačních technologií a argumentuje tezi, že je i po několika dekádách v mnoha ohledech stále vhodná výjimečné pozornosti. Následující text je rozdělen do pěti minut věnovaných současné podobě základních konceptů právní informatiky, tj. chápání práva jako informačního systému, úloze informačních a komunikačních technologií, možnostem automatizované tvorby právních informací a konečně konceptu ticha. Čtyři z uvedených minut zabývají se otázkami, které strukturálně vycházejí z Knappova chápání rozsahu a úlohy právní informatiky. Pátá minuta naproti tomu vymezuje se vůči Knappovu názoru, že totiž role právní informatiky je čistě instrumentální. V tomto ohledu jsou představeny argumenty konkurenční teze, že přes absenci logických a matematických metod ke zpracování komplexních obsahových otázek práva, z nich především spravedlnosti, je povinností právní informatiky permanentně konfrontovat obsah práva se základní teleologií informačních technologií a samotné informace (tj. s účelem pomoci lidstvu čelit entropii). Na konci páté minuty pak je představen intuitivní návrh metody k dosažení obsahového zkvalitnění současného práva (tj. ke zvýšení jeho organizační hodnoty) prostřednictvím redukce hluku. and Viktor Knapp was one of most influential figures of the history of Czechoslovak and Czech Law. This paper focuses namely on Knapp’s work in the field of legal informatics, information theory of law and law of information and communication technologies arguing that many of his teachings that are now aged many decades are still worth exceptional attention. The text is structured into five minutes explaining the recent shape of fundamental concepts of legal informatics: the understanding of law as information system, the role of information and communication technologies in law, possibilities of automated creation of legal information, information rights and the concept of silence. Four of these minutes elaborate on concepts that are structurally based on Knapp’s understanding of the scope and role of legal informatics. Fifth minute, however, is critical to Knapp’s thesis as to the limits of legal informatics as purely instrumental discipline – in that respect, the paper argues that despite having no mathematical or logical instruments to tackle complex substantive issues in law, first and foremost fairness, it is a duty for legal informatics to permanently examine the substance of law against primary teleology of information technologies an information itself (i.e. to help the mankind to counter entropy).At the end of the fifth minute, the paper intuitively suggests that recently proper method of substantive improvement of contemporary law (i.e. of improving its organizational value) is reduction of noise, i.e. promotion of silence.
