Viktor Knapp byl jednou z nejvýznamnějších osobností v historii českého a československého práva. Tento text se zaměřuje na Knappovu práci v oboru právní informatiky, informační teorie práva a práva informačních a komunikačních technologií a argumentuje tezi, že je i po několika dekádách v mnoha ohledech stále vhodná výjimečné pozornosti. Následující text je rozdělen do pěti minut věnovaných současné podobě základních konceptů právní informatiky, tj. chápání práva jako informačního systému, úloze informačních a komunikačních technologií, možnostem automatizované tvorby právních informací a konečně konceptu ticha. Čtyři z uvedených minut zabývají se otázkami, které strukturálně vycházejí z Knappova chápání rozsahu a úlohy právní informatiky. Pátá minuta naproti tomu vymezuje se vůči Knappovu názoru, že totiž role právní informatiky je čistě instrumentální. V tomto ohledu jsou představeny argumenty konkurenční teze, že přes absenci logických a matematických metod ke zpracování komplexních obsahových otázek práva, z nich především spravedlnosti, je povinností právní informatiky permanentně konfrontovat obsah práva se základní teleologií informačních technologií a samotné informace (tj. s účelem pomoci lidstvu čelit entropii). Na konci páté minuty pak je představen intuitivní návrh metody k dosažení obsahového zkvalitnění současného práva (tj. ke zvýšení jeho organizační hodnoty) prostřednictvím redukce hluku. and Viktor Knapp was one of most influential figures of the history of Czechoslovak and Czech Law. This paper focuses namely on Knapp’s work in the field of legal informatics, information theory of law and law of information and communication technologies arguing that many of his teachings that are now aged many decades are still worth exceptional attention.
The text is structured into five minutes explaining the recent shape of fundamental concepts of legal informatics: the understanding of law as information system, the role of information and communication technologies in law, possibilities of automated creation of legal information, information
rights and the concept of silence.
Four of these minutes elaborate on concepts that are structurally based on Knapp’s understanding of the scope and role of legal informatics. Fifth minute, however, is critical to Knapp’s thesis as to the limits of legal informatics as purely instrumental discipline – in that respect, the paper argues that despite having no mathematical or logical instruments to tackle complex substantive issues in law, first and foremost fairness, it is a duty for legal informatics to permanently examine the substance of law against primary teleology of information technologies an information itself (i.e. to help the mankind to counter entropy).At the end of the fifth minute, the paper intuitively suggests that recently proper method of substantive improvement of contemporary law (i.e. of improving its organizational value) is reduction of noise, i.e. promotion of silence.
