- Respekt Evropské unie k národní identitě členských států byl součástí evropské integrace od počátků a byl výslovně zmíněn již v Maastrichtské smlouvě. Teprve významné rozpracování konceptu v čl. 4 odst. 2 SEU ve znění Lisabonské smlouvy však přineslo zlom v pojetí národní identity a jejím použití v širším vztahu vnitrostátního a unijního práva.Národní identita je v současnosti úzce propojena s identitou ústavní a koncept získal právní rozměr, což umožnilo jeho častější využívání v judikatuře ústavních soudů členských zemí i Soudního dvora. Hlavním cílem článku je zodpovědět otázku, jaký praktický dopad má klauzule ukládající EU povinnost respektovat národní identitu členských států na vztah unijního a vnitrostátního práva. Jedná se o obecný derogační prvek využitelný členskými státy, nástroj pro výjimečné situace nebo pouhou proklamaci? Za jakých podmínek se lze na koncept odvolat a které druhy soudů (národní či unijní) jsou příslušné k jeho výkladu? Text analyzuje přípravu klauzule nyní obsažené v čl. 4 odst. 2 SEU, její obsah a dopady. Podrobně je diskutována judikatura ústavních soudů a Soudního dvora vázající se k národní (ústavní) identitě a možnost vzniku jednotného spolupracujícího modelu v přístupu k této záležitosti.V neposlední řadě je koncept národní identity spekulativně testován na kauze tzv. slovenských důchodů. Z provedené analýzy plyne, že klauzule je schopna posloužit jako další styčný bod ve vzájemné komunikaci národních a unijních soudů, potvrzuje se ale zároveň uvodní autorova hypotéza, že koncept reálně není schopen změnit napětí a „poměr sil“ mezi oběma úrovněmi právních řádů. and The EU’s respect for national identity of the Member States has been a part of European integration from its beginning and was expressly declared in the Maastricht Treaty.However it was the elaborate widening of the concept in Art. 4 para 2 TEU (Lisbon Treaty) which brought a change in the nature of national identity and its use in the broader relationship between national and EU law.Currently national identity is closely interrelated with constitutional identity and furthermore the concept gained legal meaning, which allowed its more frequent exploitation in the case law of Member States’ constitutional courts and the Court of Justice. The main aim of the article is to find answer to the question of what is the practical impact of the clause requiring the EU to respect national identity of the Member States on the relationship between national and EU law. Is it a general derogatory principle that might be used by the Member States, tool for extraordinary situations or mere lip-service proclamation? On what conditions is the concept invokable and which court level (EU or national) is appropriate for its interpretation? This text analyses the preparation of the clause now contained in Art. 4 para 4 TEU, its content and impact. The case law of constitutional courts and the Court of Justice related to the national (constitutional) identity is discussed in detail together with the potential emergence of common cooperating model among courts in this matter. Last but not least the concept of national identity is speculatively tested on the Slovak Pensions case . The results show that on one hand the clause is able to serve as another meeting point in the mutual conversations between national and EU courts, and on the other also confirm author’s initial hypothesis that this concept cannot change the identified tensions and „balance of powers“ between both levels of legal orders.

4. Seeing “Red” (Orange Is The New Black) – Russian Women, US Homonationalism and New Cold War Cultures

- This article investigates visual, bodily, and cultural representations of Russian women in public media and takes the TV character ‘Red’ from the popular American TV show Orange Is the New Black (OITNB) as an example. The central points of discussion are the figure’s racialisation and culturalisation. This article analyses how Red’s body, mindset, and character are produced as Russian against the background of contemporary new Cold War discourses. It argues that Red is staged as a racialised Russian other, through the emphasis on her gendered heterosexual body, within a sexually and racially diverse group of imprisoned Americans in the show. Moreover, her presentation within such a diverse group also serves to present or confirm the US nation as liberal, sexually diverse, and modern by contrasting it with Red’s strongly gendered and heterosexual body, which appears old-fashioned and from the past (also depicted as the Russian present). Referring to recent literature on the exotification and othering of Eastern European and Russian women as well as works on ethnicity and whiteness in the USA, this article is situated at the intersection of considerations of the specific racialisation of Eastern female bodies and queer and feminist discourses.
