The subject of liability for damage to client caused during performance of social services in residential establishments becomes increasingly relevant. As opposed to the liability for damage caused during performance of health services, this subject is rather underappreciated by general members of the legal profession. For this reason RILSA produced a study „Legal aspects of liability for damage caused to a client while providing a social-health care in residential establishment for social services“ that aimed to find out the level of knowledge among the providers of residential social services in the area of liability for damage. To find out the level of legal knowledge of providers of residential social services, a question form was distributed randomly in the Czech Republic. We found out, that providers of residential social services know about the existence of liability for damage and that they are insured. But in the case of significant incurred damage or in the case of more damages within one year the insurance coverage limit might not be sufficient. V současné době jsou v ČR pro potřeby zdravotnictví a sociální oblasti k dispozici dva klasifikační systémy. K všeobecně známé a v praxi osvědčené Mezinárodní klasifikaci nemocí a přidružených zdravotních problémů ve znění desáté decenální revize (zkráceně MKN-10) přibyla od roku 2008 i Mezinárodní klasifikace funkčních schopností, disability a zdraví (zkráceně MKF). Vzhledem k odlišnému účelu i použití obou klasifikací lze očekávat, že se v praxi postupně uplatní obě dvě. MKN-10 je mezinárodní standardní diagnostická klasifikace pro účely obecně epidemiologické, pro řízení zdravotnictví i pro klinickou praxi. Poskytuje srovnatelný základ pro mezinárodní srovnávání mortality a morbidity. MKF je naproti tomu klasifikace zdraví a se zdravím spjatých domén. Představuje rámec pro měření zdraví a disability jak na úrovni jedince, tak na úrovni celé populace. MKF chápe pojmy "zdraví" a "disabilita" ve zcela novém světle. "Disabilita je snížení funkčních schopností na úrovni těla, jedince nebo společnosti, která vzniká, když se občan se svým zdravotním stavem setkává s bariérami prostředí". Každý člověk může zažít újmu na zdraví, a tak pocítit určitý stupeň disability. MKF bere v úvahu i sociální důsledky disability, a je tudíž mimořádně vhodnou klasifikací zdravotního stavu starší populace., There currently exist two systems of classification for health care and social care in the Czech Republic. There is the generally known and time-tested International Classification of Diseases in its 10th version (in short ICD-10). Then there is the International Classification of Functioning, Disability and Health (in short ICF), which was added in 2008. Given the different use and purpose of each classification, we expect that both of them will gradually coexist in practice. The ICD-10 is the international standard diagnostic classification for all general epidemiological, many health management purposes and clinical use. It provides common basis for international comparisons of mortality and morbidity. The ICF is a classification of health and health-related domains. It presents a framework for measuring health and disability at both individual and population levels. ICF understands the notions of "health" and "disability" in a new light: "Disability is a functional limitation at body, individual or society level which happens when an individual with his health level meets environmental barriers". Everybody may experience decreased health and therefore feel certain level of disability.
