V 19. a ve 20. století byl stát ovládán principy abstrakce, linearity, symetrie, obecnosti, univerzálností, racionality, byrokracie, právního státu, ústavy a ústavnosti, ambice na úplnost (institucionální), vnitřní suverenity (výlučnosti), vnější suverenity (stát je základním subjektem mezinárodního práva), pořádacími principy právního řádu, mezi něž patří bezrozpornost a obsahová konzistentnost, stupňovitá výstavba, relativní ustálenost systému práva a jeho jazyka, relativní stálost práva. Zdá se, že zaniká moderní stát, nezaniká ale stát ve významu obecnějším. Čelíme absenci obecně sdíleného důvodu legitimity moci, absenci zdůvodnění statusu jednotlivce, zásadní modifikaci kategorií vnitřní a vnější suverenity, ztrátě funkčnosti státu a opuštění pořádacích principů právního řádu. Rok 1989 a roky následující byly dobou vedenou heslem návratu k (demokratické) modernitě. Dělo se tak již v okamžiku jejího zániku. and In the 19th and 20th centuries, the state was governed by the following principles: abstraction, linearity, symmetry, generality, universality, rationality, bureaucracy, rule of law, constitution and constitutionality, ambition of wholeness (institutional), internal sovereignty (exclusivity), external sovereignty (the state is the basic subject of international law), organizational principles of the legal system, including lack of contradictoriness and consistency of content, a hierarchical structure, relative stability of the system of law and its language, relative stability of the law. While the modern state seems to be disappearing, the state in a more general sense is not ceasing to exist.We are faced with an absence of generally shared grounds for the legitimacy of power, an absence of justification of the status of the individual, a fundamental modification of the categories of internal and external sovereignty, loss of functionality of the state and abandonment of the organizational principles of the legal order. Year 1989 and subsequent years were marked by a proclaimed return to (democratic) modernity. This was already when modernity ceased to exist.
