Současné unijní právo splňuje všechny znaky, jimiž právní věda definuje pojem právního řádu. Je soudržným, formálním, uceleným, úplným a efektivním souborem závazných pravidel upravujících chování Unie, jejích členských států i osob, jež Unii podléhají. Uchovává si rozhodující vliv v poměru k vnitrostátnímu právu. Je vůči němu v postavení „ústředního systému“ a usměrňuje chování členských států i obsah jejich právních řádů. Disponuje k tomu účinnými procesními i sankčními prostředky. Přes občasné „revolty“ jednotlivých členských států a jejich ústavních soudů zatím nebyla nezávislost unijního právního řádu v ohledu práva vnitrostátního vystavena závažnému ohrožení.Vztahy mezi unijním právem
a právem mezinárodním jsou naopak mnohem složitější. Soudní dvůr před půlstoletím komunitární právo poněkud voluntaristicky z mezinárodního práva vydělil a přesunul je k právu vnitrostátnímu. V důsledku toho se právo ES/EU stalo satelitním systémem mezinárodněprávního řádu. Část členských států, některé ústavní soudy, ale i judikatura ESLP zacházejí v určitých ohledech s unijním právem jako s tzv. autonomním režimem, propojeným s obecným mezinárodním právem. To s sebou nese, že ve vztazích mezi Unií a členskými státy, jakož i mezi členskými státy v rámci působnosti unijního práva, jsou právně relevantní pravidla obecného mezinárodního práva. Ta nesystémově vytvářejí konkurenci unijní úpravě
a erodují působnost zásad výlučnosti a přednosti unijního práva, na nichž je jeho nezávislost založena. Soudní dvůr na toto ohrožení nezávislosti unijního právního řádu reagoval ve svém posudku slučitelnosti návrhu dohody o přistoupení EU k EÚLP s primárním unijním právem. Tento posudek lze označit za „manifest“ autonomie unijního právního řádu. and Since the famous COSTA v ENEL judgment was handed down in 1964,European Union law (EU law) has substantially changed and transformed. As a consequence this law no longer possesses several of the qualities which led the Court of Justice to affirm in that case the existence of a new Community legal order.Nevertheless, EU law currently possesses and maintains all the indispensable dogmatic elements which permit it to qualify as a specific legal order. It is a unique, consistent, independent, formal, coherent, complete and effective set of legal rules. It is nonetheless imperative that EU law can defend its independence in relation to other concurring legal orders, i.e. domestic law and international law. As regards domestic law, EU law maintains the strong position of a central legal order, while the domestic legal orders of the EU Member States are satellite systems in relation to it, determined thus by EU law rules. Notwithstanding occasional “rebellions” by some Member States
and, in particular, by some of the Constitutional Courts of those States against the primacy of EU law (constitutional reinterpretation of some crucial primary law provisions, such as Article 267 TFEU, “ultra vires” procedures and so on), the independence of EU law continues to be preserved as it has at its disposal a set of effective remedies and means of constraint which guarantee that in the case of a clash or conflict between EU law and domestic law(s), EU law prevails. In relation to international law, the situation is much more delicate, because it is international law which plays the role of
a central legal order, whereas EU law finds itself in the position of a satellite system.Certain Members States, several Constitutional Courts and also importantly the European Court of Human Rights treat EU law in some regards as a “self-contained regime” interconnected with international law.
The foregoing implies that even in intra-Union relations between Members States and between those States and the Union, general international law should be relevant and applicable.Such an approach threatens the independence of EU law. The Court of Justice has recently dismissed this perception in its n° 2/13 Opinion from December 2014 concerning the draft agreement on the Accession of the European Union to the European Convention on Human Rights. This Opinion may be considered as a true “manifesto” for the independence of EU law vis-a`-vis international law.
