At first glance, the Israeli right might be regarded as a sort of monolith. Characterized by intransigence vis-à-vis the great powers (initially the British) and the Arabsalike and with iconic strongmen at the helm, both the post-independence Herut party and its interwar predecessor(s) clearly demonstrated to the outside world what Zionist maximalism stood for, particularly in terms of its political and terriotiral demands. on a closer look, however, many of the sought after parallels between the interwar Zionist right and the post-independence Israeli right are more imagined than real. in fact, not only were the particular groupings made up of different sets of players (often in opposition to each other), but their very worldviews differed, sometimes fundamentally. Tento článek se zabývá problematikou žalob „wrongful life“ z pohledu izraelského práva. Jeho cílem je objasnit důvody, proč bylo možné přijmout takové nároky a popsat vývoj tohoto problému. Článek nejprve poskytuje obecný úvod do problematiky žalob „wrongful life“ a „wrongful birth“. Dále popisuje izraelské a zejména židovské kulturní pozadí a zaměřuje se především na specifický přístup k životu a podpoře porodnosti. Zmiňuje i tamní přístup k postiženým lidem a v této souvislosti k jejich základním lidským právům. Následující kapitola poskytuje přehled vývoje právního přístupu k této problematice a soustředí se zde na tři klíčové případy, konkrétně na případ Zeitsov v. Katz (1986), případ R.V. v. Maccabi Healthcare Services (HMO), (2008), a spojený případ Hammer (2012). Tato kapitola ukazuje, jak došlo k výraznému posunu od původního odůvodnění izraelského Nejvyššího soudu, který nejdříve povolil žaloby „wrongful life“ s poukazem na to, že některé životy nestojí za to žít, k opačnému přístupu, který hlásá, že život jako takový nelze považovat za škodu bez ohledu na to, jak složitý ten život může být. Izraelský přístup k problému je následně stručně kriticky zhodnocen. Článek uzavírá tvrzení, že k předestřenému ideovému posunu došlo i na základě moderního technologického rozvoje. and This paper is devoted to the issue of “wrongful life” claims in Israeli law. Its aim is to show the reasons why it was made possible to accept such claims and to describe the development of the problem. First of all, the paper provides a general introduction to the problematic of wrongful life and wrongful birth claims. Next, Israeli and namely Jewish cultural background are described with a particular focus on the specific approach to promotion of life and procreation including the approach to disabled people and related human rights. The following chapter provides an overview of the development of legal approach to the problem focusing on three crucial cases, namely the case Zeitsov v. Katz (1986), the case R.V. v. Maccabi Healthcare Services (HMO), (2008), and the joint case Hammer (2012). The chapter shows that there has been a major shift from the initial reasoning when the Israeli Supreme Court allowed acceptance of wrongful life claims based on an assumption that some lives are not worthy to be lived to the approach that life as such cannot be considered as harm no matter how difficult it may be. Later, a brief critical assessment of the Israeli approach is provided. The paper concludes with a statement that a modern technological development also contributed to the outlined ideological shift.
